Is Cannabis Legal in California in 2026? Everything You Need to Know

California was the first state to legalize medical marijuana back in 1996, and it has been at the forefront of cannabis legalization ever since. If you live here or are visiting, understanding what is legal, what is not, and where you can buy is straightforward once you know the rules. Here is everything current as of April 2026.

Is Cannabis Legal in California in 2026?

Yes. California legalized recreational cannabis for adults 21 and older through Proposition 64 in 2016. Adults can purchase, possess, and use cannabis legally from licensed dispensaries across the state. Medical marijuana has been legal since 1996 under Proposition 215.

California remains one of the most active and mature cannabis markets in the world, with hundreds of licensed dispensaries, delivery services, consumption lounges, and cannabis events operating statewide.

How Much Cannabis Can You Possess in California?

Adults 21 and older may legally possess up to 1 ounce (28.5 grams) of cannabis flower and up to 8 grams of cannabis concentrate at any given time. Possession of more than the legal limit is a civil infraction or misdemeanor depending on quantity.

Medical marijuana patients with a valid physician’s recommendation can possess larger amounts as deemed appropriate by their doctor.

Where Can You Buy Cannabis in California?

Only from a licensed retailer. California has both storefront dispensaries and licensed delivery services. You can find licensed retailers through the state’s Bureau of Cannabis Control website or through Leafly and Weedmaps, which list verified licensed shops.

Purchasing from unlicensed sellers remains illegal and carries real risks, including unregulated, untested products.

Can You Grow Cannabis at Home in California?

Yes. Adults 21 and older may grow up to 6 cannabis plants per household for personal use. The plants must be grown in a private space not visible from a public area. Some local jurisdictions have banned or restricted home cultivation, so check your city or county rules before planting.

Can You Consume Cannabis in Public in California?

No. Smoking or vaping cannabis in public remains illegal in California, just like tobacco smoking in public spaces. Consumption is permitted in private residences and at licensed cannabis consumption lounges, which operate in several California cities including Los Angeles and San Francisco.

Consuming cannabis in a vehicle, even as a passenger, is also illegal.

Can You Travel With Cannabis in California?

You can travel within California with cannabis up to the legal possession limit. Taking cannabis across state lines, including into Nevada, Oregon, or Arizona, is a federal offense regardless of whether those states have legalized cannabis. Do not take California cannabis on planes, even for domestic flights, as airports fall under federal jurisdiction.

If you want THC products in California, you need to buy from a licensed cannabis dispensary.

What Are California Cannabis Taxes?

California cannabis is taxed at multiple levels. The state excise tax is 15 percent at the point of sale. Local sales taxes and local cannabis taxes vary by city and county and can push the total tax burden to 30 to 40 percent in some markets. This is one reason the unlicensed market still exists in California despite full legalization.
